Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the RideClicker application (“Service”, “App”) operated by RideClicker (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“Service” refers to the RideClicker mobile application and all associated features.

“User” or “You” refers to any person who downloads, installs, registers for, or uses the Service.

“Third-Party Platforms” refers to third-party ride-hailing applications that the Service is configured to support.

“Accessibility Service” refers to the Android Accessibility Service API used by the App to interact with Third-Party Platforms on your behalf.

“Automation” refers to the automated detection and acceptance of ride requests performed by the Service.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age;
• Hold a valid driving license issued in India;
• Be a registered driver on at least one Third-Party Platform;
• Be a resident of India;
• Have the legal capacity to enter into a binding agreement.

3. Nature of Service

RideClicker is a productivity tool that uses Android Accessibility Services to automate the acceptance of ride requests on Third-Party Platforms. The Service is NOT a ride-hailing platform, a transport aggregator, or an employer. We do not employ, contract, or engage you in any capacity. The relationship between you and Third-Party Platforms is independent of your use of this Service.

4. Account and Device

• You must sign in using a valid Google account. You are responsible for maintaining the confidentiality and security of your account.
• Each active subscription is bound to a single device. Unauthorized use on multiple devices simultaneously is not permitted.
• You must provide an accurate phone number during registration for support and communication purposes.

5. Subscription and Payments

• The Service operates on a prepaid subscription model. Payments are accepted via UPI.
• Subscriptions are non-refundable unless otherwise determined at our sole discretion.
• Wallet balance earned through the referral program may be applied toward subscription renewal as per the referral terms in effect at that time.
• We reserve the right to modify subscription plans, pricing, and payment terms at any time.

6. Acceptable Use

You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
• Share, transfer, or sell your subscription credentials or account access to any third party;
• Use the Service for fraudulent ride farming, fake ride generation, or any form of platform manipulation;
• Use the Service in any manner that violates applicable laws or regulations;
• Modify, adapt, or create derivative works based on the Service.

7. Third-Party Platform Compliance

YOU ACKNOWLEDGE AND AGREE THAT:

• The use of RideClicker to automate interactions with Third-Party Platforms may violate the terms of service, acceptable use policies, or community guidelines of those platforms;
• You use this Service entirely at your own risk and discretion;
• You accept sole and complete responsibility for any and all consequences arising from the use of this Service, including but not limited to: account warnings, temporary suspension, permanent deactivation, withholding of earnings, fines, penalties, or legal action by any Third-Party Platform;
• We have no control over and bear no responsibility for the policies, enforcement actions, or decisions of any Third-Party Platform;
• We do not guarantee that the Service will not be detected by any Third-Party Platform.

8. Intellectual Property

All rights, title, and interest in the Service, including but not limited to the source code, design, branding, trademarks, and all related materials, are and shall remain the exclusive property of RideClicker. No licence or right is granted to you except the limited right to use the Service in accordance with these Terms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory;
• We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected;
• In no event shall our total aggregate liability to you for all claims arising out of or relating to the use of the Service exceed the total amount of subscription fees paid by you in the three (3) months immediately preceding the event giving rise to such liability;
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, earnings, data, or goodwill.

10. Indemnification

You agree to indemnify, defend, and hold harmless RideClicker, its owners, officers, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any action taken against you by any Third-Party Platform in connection with your use of the Service.

11. Termination

• We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, particularly if you breach these Terms.
• Upon termination, your right to use the Service ceases immediately. No refund of subscription fees shall be issued upon termination for cause.
• You may stop using the Service at any time.

12. Modifications to Terms

• We reserve the right to modify these Terms at any time.
• Material changes to these Terms will require your renewed acceptance through the in-app consent mechanism before you can continue using the Service.
• Your continued use of the Service after accepting updated Terms constitutes your agreement to the revised Terms.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: changes in Third-Party Platform user interfaces or policies, Android operating system updates, government orders or regulations, natural disasters, network outages, or acts of any regulatory authority.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and RideClicker with respect to the use of the Service.
