Please read this Disclaimer carefully before using the RideClicker application (“Service”). By using the Service, you acknowledge that you have read, understood, and agreed to this Disclaimer.

1. Service Provided “As Is”

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. RideClicker (“we”, “us”, “our”) makes no representations or warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

2. What the Accessibility Service Does

RideClicker uses Android’s Accessibility Service API to:

• Read the screen content ONLY of the specific ride-hailing driver apps listed in its configuration;
• Perform automated tap gestures to accept ride requests on those specific apps;
• Operate ONLY when the Accessibility Service is explicitly enabled by you through your device’s system settings.

3. What the Accessibility Service Does NOT Do

We want to be clear and transparent about the boundaries of our Service. The RideClicker Accessibility Service:

• Does NOT access, read, copy, or store your photographs, gallery, camera, or any media files;
• Does NOT access your contacts, messages, SMS, call logs, or any communication data;
• Does NOT access, read, modify, or delete any files, documents, or downloads on your device;
• Does NOT access, read, or interact with any banking application, UPI application, payment wallet, or any financial application whatsoever;
• Does NOT access your browsing history, bookmarks, or data from any app other than the specific ride-hailing driver apps it is configured to monitor;
• Does NOT record, capture, screenshot, or transmit your screen content to any server, cloud service, or third party;
• Does NOT track your GPS location or real-time geographical position (the city and state information in the App is manually selected by you);
• Does NOT access your device’s microphone, camera, or any sensor other than what Android’s Accessibility API provides;
• Does NOT run, perform, or execute any action whatsoever when the Accessibility Service is turned off or disabled;
• Does NOT access, modify, or interfere with any system settings, installed apps, or device configuration beyond the scope of its declared accessibility capabilities.

4. Third-Party Platform Risk

BY USING THIS SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND ACCEPT THAT:

• The use of any automation tool, including RideClicker, to interact with Third-Party Platforms may violate the terms of service, acceptable use policies, driver agreements, or community guidelines of those platforms;
• Third-Party Platforms may take action against your driver account, including but not limited to: issuing warnings, imposing temporary suspensions, permanently deactivating your account, withholding or forfeiting your earnings, imposing financial penalties, or pursuing legal action;
• You use this Service entirely at your own risk, with full knowledge and understanding of the potential consequences;
• We have no control over, influence on, or responsibility for the policies, algorithms, detection mechanisms, or enforcement actions of any Third-Party Platform;
• WE BEAR ABSOLUTELY NO LIABILITY FOR ANY ACTION TAKEN BY ANY THIRD-PARTY PLATFORM AGAINST YOUR ACCOUNT, EARNINGS, OR STANDING IN CONNECTION WITH YOUR USE OF THIS SERVICE.

5. No Guarantee of Performance

We do not guarantee that:

• The Service will successfully accept every ride request;
• The Service will accept only rides that match your configured filters;
• The Service will function without interruption, delay, or error;
• The ride acceptance will occur within any specific time frame;
• The Service will be compatible with future updates to Third-Party Platform apps or the Android operating system.

Missed rides, incorrectly accepted rides, acceptance failures, or delayed responses may occur due to network conditions, device performance limitations, Third-Party Platform UI changes, Android system behaviour, or other factors beyond our control.

6. Financial Loss Disclaimer

WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE FINANCIAL LOSSES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Lost earnings from missed or failed ride acceptances;
• Penalties, fines, or deductions imposed by any Third-Party Platform;
• Subscription fees paid for periods during which the Service was unavailable or malfunctioning;
• Costs associated with device damage, misconfiguration, or excessive battery consumption;
• Any losses arising from incorrect ride acceptance or filter misconfiguration.

7. Indemnification

You agree to indemnify, defend, and hold harmless RideClicker, its owners, officers, agents, employees, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these terms, or any claim made by a Third-Party Platform or any other third party in connection with your use of the Service.

8. Maximum Liability

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF RIDECLICKER FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES ACTUALLY PAID BY YOU IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

9. Force Majeure

We shall not be liable for any failure or delay in the performance of the Service resulting from circumstances beyond our reasonable control, including but not limited to: changes in Third-Party Platform user interfaces, APIs, or policies; Android operating system updates or changes; government orders, regulations, or directives; natural disasters; internet or network outages; acts of any regulatory or judicial authority; or any other event of force majeure.

10. No Professional Advice

The Service is a software tool. We do not provide legal, financial, tax, or professional driving advice. Any decisions you make regarding your driving activities, platform engagement, or financial matters are solely your own responsibility.

11. Governing Law and Jurisdiction

This Disclaimer shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to this Disclaimer shall be subject to the exclusive jurisdiction of the courts in India.
